Data submitted through contact forms not resulting in a contractual relationship is deleted within 90 days.

1.6 Data Sharing. We do not sell, rent, or trade your personal data. Data may be shared with third-party service providers (hosting, payment processing) strictly under data processing agreements that comply with GDPR Article 28.

Section 03 — Refund Policy

3.1 Project-Based Refunds. All services provided by brightlayoutco are delivered as project-based engagements. Refund eligibility is evaluated based on the project milestone stage at the time of the request.

3.2 Pre-Production Cancellation. If a project is cancelled before any production work has commenced (within 48 hours of the initial payment), a full refund will be issued minus a 5% administrative processing fee.

3.3 Mid-Production Cancellation. Projects cancelled after production has begun are eligible for a partial refund calculated based on the proportion of completed milestones versus total project scope. Work already delivered and accepted by the client is non-refundable.

3.4 Completed Deliverables. Once a deliverable has been formally accepted by the client (via written confirmation or continued use), it is considered final and non-refundable.

3.5 Refund Processing. Approved refunds are processed within 14 business days to the original payment method. brightlayoutco reserves the right to request additional information to verify refund eligibility.

3.6 Dispute Resolution. Refund disputes should be directed to [email protected]. We commit to responding to all refund inquiries within 3 business days.

Section 04 — Terms of Service

4.1 Agreement. By engaging the services of brightlayoutco (Calle de Santa Engracia 70, Madrid, Chamberí, España, España), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between the client and brightlayoutco.

4.2 Scope of Services. All services are defined in the project proposal or statement of work (SOW) agreed upon prior to commencement. Any work outside the defined scope constitutes a change request subject to additional fees and separate approval.

4.3 Payment Terms. Invoices are issued according to the milestone schedule defined in the project SOW. Payment is due within 14 days of invoice date. Late payments incur a 1.5% monthly interest rate. Projects may be paused if payment is overdue by more than 30 days.

4.4 Intellectual Property. Upon full payment, all final deliverables and associated intellectual property rights are transferred to the client. brightlayoutco retains the right to display completed work in portfolio materials unless otherwise agreed in writing.

4.5 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the agreement for a period of 24 months.

4.6 Limitation of Liability. brightlayoutco's total liability under any engagement shall not exceed the total fees paid by the client for the specific project in question. We are not liable for indirect, incidental, or consequential damages.

4.7 Termination. Either party may terminate the agreement with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date.

4.8 Governing Law & Jurisdiction. These Terms of Service are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

4.9 Amendments. brightlayoutco reserves the right to update these terms. Clients will be notified of material changes via email at least 30 days before they take effect.
